Terms & Conditions

By accessing, browsing, or using the platform in any manner, the user expressly acknowledges that they have read, understood, and agree to be legally bound by these Terms & Conditions, along with all incorporated policies. These Terms constitute a binding agreement between the user and the platform operator. The scope of these Terms extends to all services, features, content, and interactions facilitated through the platform, whether accessed via website, mobile application, or any other interface. Continued use after updates constitutes deemed acceptance of revised terms.

For clarity, “Platform” refers to the website and its services; “User” includes buyers, sellers, tenants, landlords, agents, and visitors; “Content” includes listings, text, images, videos, and data; and “Services” refers to all functionalities provided. Interpretation of these Terms shall be governed by principles of applicable Indian law, and headings are for convenience only and shall not affect interpretation.

The platform functions strictly as an intermediary technology service provider enabling users to list, discover, and interact regarding real estate opportunities. It does not act as a broker, agent, representative, or fiduciary of any user. No agency, partnership, joint venture, or employment relationship is created by use of the platform. The platform does not participate in negotiations, execution of agreements, or transfer of property rights and disclaims all responsibility in relation thereto.

Users represent and warrant that all information provided by them is accurate, complete, and up to date. Property listers specifically warrant that they have legal rights, authority, and necessary approvals to advertise the property. Users further represent that their activities comply with all applicable laws, including zoning regulations, tax laws, and property ownership regulations. Any misrepresentation may result in legal liability and immediate termination of access.

The platform reserves the right to conduct Know Your Customer (KYC) verification, including identity validation, phone/email verification, and document checks. While such verification may reduce risks, it does not guarantee authenticity or legality of users or listings. Users acknowledge that they remain solely responsible for conducting independent due diligence, including verification of title, encumbrances, approvals, and compliance with the Real Estate (Regulation and Development) Act, 2016.

All structured data, including listing databases, search results, analytics, and platform-generated insights, shall remain the exclusive property of the platform. Unauthorized extraction, scraping, mining, or reuse of such data—whether manually or through automated means—is strictly prohibited. Such acts may constitute violation under the Information Technology Act, 2000 and applicable intellectual property laws.

In addition to standard copyright protections under the Copyright Act, 1957, the platform asserts rights over its proprietary algorithms, search ranking logic, recommendation systems, and UI/UX architecture. Users shall not attempt to reverse engineer, replicate, or commercially exploit any part of the platform’s technology or design. Any feedback provided by users may be used by the platform without restriction or compensation.

All listings must be truthful, lawful, and non-misleading. Listings must include accurate descriptions, correct pricing, and required disclosures such as approvals and registration numbers where applicable. Duplicate, spam, or artificially boosted listings are prohibited. The platform reserves unilateral rights to edit, reclassify, or remove listings that violate policies or negatively impact user experience.

The platform may integrate with third-party services such as payment gateways, CRM tools, map services, or advertising networks. The platform does not control or assume responsibility for such third-party services, and users agree that their use of such services is subject to the respective third-party terms and policies.

Users agree to pay all applicable fees, including taxes such as GST, for paid services. The platform may use third-party payment processors and shall not be liable for transaction failures caused by such providers. Invoices, where applicable, shall be generated electronically. Non-payment may result in suspension of services.

Refunds are generally not permitted except in cases of proven technical errors or duplicate transactions. Users initiating unjustified chargebacks may be permanently restricted and subject to recovery proceedings. The platform reserves the right to investigate and resolve payment disputes at its discretion.

To the maximum extent permitted by law, the platform disclaims all liability for indirect, incidental, consequential, or punitive damages. This includes loss of profits, business interruption, reputational harm, or data loss. The platform shall not be liable for fraud committed by users, inaccuracies in listings, or failure of transactions. Aggregate liability shall not exceed the total fees paid by the user in the preceding six months.

Users agree to indemnify and defend the platform against all claims, including those arising from regulatory violations, intellectual property infringement, fraud, misrepresentation, or disputes with other users. This indemnity extends to legal costs, penalties, settlements, and damages.

The platform shall not be liable for failure or delay in performance due to events beyond its reasonable control, including natural disasters, war, cyberattacks, government restrictions, or infrastructure failures.

The platform reserves the right to suspend, restrict, or permanently ban users for violations, suspicious behavior, or legal risks. It may also blacklist devices, IP addresses, or payment methods associated with abuse.

All disputes shall first be attempted to be resolved amicably. Failing resolution, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. Arbitration shall be conducted by a sole arbitrator, and the decision shall be binding. Courts shall have jurisdiction only for enforcement.

The platform collects, processes, and stores personal data necessary for service delivery, analytics, fraud prevention, and marketing. Data may include sensitive personal information where required for verification. Processing is conducted in accordance with the Information Technology Act, 2000 and related rules.

Data retention shall be limited to the duration necessary for business or legal purposes. Users may exercise rights such as access, correction, or deletion, subject to legal obligations. Cross-border data transfers may occur with adequate safeguards.

The platform uses first-party and third-party cookies, tracking pixels, and analytics tools to understand user behavior, optimize performance, and deliver targeted advertisements. These may include session cookies, persistent cookies, and advertising identifiers.

Users consent to such tracking upon use of the platform. Opt-out options may be available through browser settings or third-party tools; however, disabling cookies may impair functionality.

The platform employs automated and manual systems to detect suspicious activity, including AI-based fraud detection and behavioral monitoring. Listings or users identified as high-risk may be restricted or removed.

Despite such measures, users acknowledge that fraud risks exist in online marketplaces and agree to exercise independent caution.

The platform makes no warranties regarding: • Accuracy or completeness of listings • Legal status of properties • Reliability of users • Continuous or error-free operation All services are provided “as-is,” and users assume full responsibility for their decisions.

The platform may update policies periodically. Updated versions shall be effective upon publication. Users are encouraged to review policies regularly.

All clauses are intended to be severable. If any provision is held invalid or unenforceable, the remaining provisions shall continue in full force.
